After leaving Amazon, he became a consultant and launched ecommerceChris where he teaches sellers how to think like Amazon, protect their accounts, and appeal listing restrictions and suspensions.

How To Communicate With Seller Performance (and not be ignored)

How Amazon internal teams review and dissect, and ultimately accept or reject seller appeals, will focus on ASIN listing blocks and how to prevent an overall account suspension. I’ll delve into the best ways to respond to Performance Notifications, and what to do next if they ever ask for “more information” or even if you get rejected. Proper format of a viable Plan of Action and what’s necessary to write in an escalation letter all will be included.

Paul Rafelson is a tax attorney representing online merchants in tax and other business matters. Prior to advising online merchants, Paul spent over 12 years defending Fortune 100 companies in complex state tax litigation matters, spending most of his career as in-house tax counsel for Microsoft, Walmart and General Electric.

Paul holds an LL.M. (Master of Laws) in Taxation from New York University (“NYU”), a J.D. and M.B.A. from Villanova University, and a Bachelor’s in accounting from the University of Massachusetts, Amherst. Paul is also an adjunct professor at Pace Law School in New York where he teaches a state and local tax constitutional law course, and he is the acting Chairman of the newly launched online merchant focused trade association, Online Merchants Guild.

Comply or Fight? The Tax Threat from the States

State tax authorities have gone into hyper-aggressive enforcement mode against online merchants. States want merchants to collect in every state Amazon has a distribution center, but this is only the beginning. Collecting sales tax, in the state’s view, opens you up to other tax filing responsibilities such as income tax franchise tax, filing fees, even property tax in some states. The cost of complying all of these requirements in just 25 states could easily exceed $100,000 (USD). We expect states to continue to send audit letters, meaning the associated filing costs will increase. State governments hope that the Supreme Court case will pave the way to make more sellers comply regardless of physical presence. I’ll show you what you need to do.

Vern Francissen is an IP attorney with over 20 years of experience in prosecuting, litigating and counseling in patent and trademark matters. Vern was lead patent counsel at Microsoft to the Chief Software Architect as well as the business groups for mice and keyboards, Surface, Hotmail and OneDrive.

Vern holds a J.D. from the University of Wisconsin, a BS in Electrical Engineering from the University of Illinois at Urbana-Champaign, and an MS in Electrical Engineering from the Illinois Institute of Technology. Vern is a registered patent attorney with the US Patent and Trademark Office and an active member of the California and Illinois bars.
